What happens to the spirit of a sinner when he dies?

I heard a pastor say that when a sinner dies, his body goes to the grave obviously, his soul goes back to God, but his spirit is in a state of unrest until the day of judgement. He said that these are the spirits that are out in the air right now that are causing so many people to sin and to do wicked things? That they use people's bodies to make them to do evil things? (e.g. fornication, malice, killing, stealing, etc) I always tought that when a person dies without God their spirit is in a state of unrest, but not that it becomes sort of like an evil spirt that causes the living to do evil things? What do you guys think?
